Welcome to Calibrain AI ("we," "us," or "our"). By using this app, you agree to the following Terms of Service ("Terms"). If you do not agree, please do not use the app.

1. Eligibility

You must be at least 13 years old and legally capable of entering into a binding agreement to use the app.

2. Description of Service

Calibrain AI is a nutrition and activity tracker designed to help you stay within your caloric budget and make informed, healthy decisions. It integrates with Apple HealthKit to combine activity data with nutritional inputs, such as scanned foods or logged meals.

3. Apple Sign In and Apple HealthKit

We use Sign In with Apple for secure authentication. When you sign in, we receive:

• Your name (if shared)
• Your email address (which may be anonymized using Apple's relay service)

We access HealthKit solely to:

• Read your activity data (e.g., active energy burned)
• Sync the last 30 days of activity, and only when the app is open

We do not write any data to HealthKit.

4. Data Collection and Storage

We are committed to collecting and storing as little personal data as possible. We store:

• Your name and email address (as provided via Apple Sign In)
• The last 30 days of activity data synced from your device

Important: Although we only sync 30 days of data from your device, we may store this data indefinitely on our servers for ongoing analysis and historical insights — unless you delete your account, in which case all your data will be permanently deleted.

All stored data is encrypted and handled with care.

5. Account Deletion

You may delete your account at any time via the app settings. Upon deletion:

• All personal data on our servers will be permanently erased
• This process is immediate and irreversible

6. Fair Use

We provide AI-powered services to help you analyze your nutrition and activity patterns. To maintain performance for all users, you agree to use these features responsibly. We reserve the right to limit or restrict usage if:

• You excessively or automatically query AI systems
• Your behavior negatively impacts service stability
• You attempt to misuse or exploit the platform

We may introduce usage caps or rate-limiting features without notice.

7. Termination

We reserve the right to suspend or terminate your access to the app at any time, for any reason, including:

• Violating these Terms
• Abusing system features or causing harm to the app or other users
• Excessive or malicious use of AI systems

8. User Responsibilities

By using the app, you agree to:

• Provide accurate personal data where required
• Not interfere with app functionality or attempt unauthorized access
• Use the app solely for personal, non-commercial use unless explicitly permitted

9. AI-Powered Features and Limitations

Some insights and recommendations in the app are generated by AI models trained on general data and heuristics. As such:

• We make no guarantees regarding the accuracy, completeness, or suitability of AI-generated suggestions
• AI may occasionally generate incorrect, outdated, or misleading information (so-called "hallucinations")
• You must not rely on AI-generated outputs for critical health, medical, or emergency decisions

10. User Obligation to Verify

You are solely responsible for:

• Evaluating the appropriateness of any advice provided by the app
• Consulting qualified professionals (e.g., doctors, nutritionists) before acting on app recommendations
• Verifying the accuracy of AI-generated content, especially where health decisions are concerned

11. AI Consent Notice

By using any AI-powered feature in the app, you acknowledge and agree that:

• The outputs are not human-reviewed
• The results are provided "as-is" with no warranty or guarantee
• You accept full responsibility for any actions you take based on these recommendations

12. Intellectual Property

All app content (excluding your personal data) is the intellectual property of Zoom7 GmbH or licensed to us. You may not reproduce, reverse-engineer, or redistribute any part of the app without our permission.

13. Limitation of Liability

To the fullest extent allowed by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the app or reliance on its data.

14. Changes to These Terms

We may update these Terms periodically. If we make significant changes, we'll notify you in-app or via email. Your continued use of the app after changes are published implies acceptance of the revised Terms.
